Abstract
This article examines the intellectual and legal framework for the protection of intellectual property, beginning with the importance of creativity and innovation in social progress and the need to safeguard the rights of authors, inventors, and creators. The author traces the historical development of the concept of intellectual property, referring to early forms of protection in ancient civilizations and Islamic jurisprudence, before discussing the emergence of modern European laws governing copyright and industrial property. The article emphasizes the international dimension of protection by reviewing major conventions and treaties, including the Paris Convention for the Protection of Industrial Property, the Berne Convention for the Protection of Literary and Artistic Works, the Madrid Agreement, and agreements administered by the World Intellectual Property Organization. It also discusses how information and digital transformations have renewed intellectual property challenges, requiring updated legislation and a balance between the rights of creators and producers and the public’s right to access knowledge. The article concludes that effective intellectual property protection depends on a developed legal framework, public awareness of rights, and national and international cooperation responsive to technological and knowledge-based change.
