Abstract

This article examines intellectual property rights in the new generation of information systems, focusing on the transformations introduced by digital environments in the circulation, access, and reproduction of works within libraries and Internet-based resources. The author begins by outlining the international framework for intellectual property protection, including the role of the World Intellectual Property Organization and related agreements, before discussing how modern legislation regulates the relationship between authors, publishers, libraries, and users. The article analyzes the concepts of fair use and fair dealing, the limits of private copying, and reproduction for educational and research purposes, emphasizing the relevance of the portion used and the purpose of use in determining legality. It also discusses moral rights and electronic rights, as well as the difficulty of applying traditional copyright rules to Internet sources, databases, digital libraries, and multimedia works. Special attention is given to libraries’ obligations in protecting intellectual property, including compliance with licensing terms, restricting content use, cooperating with rights holders, and implementing security measures to prevent infringement. The article concludes that protecting intellectual property in new information systems requires a careful balance between access to knowledge and the legal, moral, and economic rights of creators and rights holders.
